The Wicked — Terms of Service

1. Acceptance of Terms
By creating an account, using, or accessing any service offered by The Wicked (collectively, "Platform" or "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use our Services.
The Wicked provides the following digital services:
- BioPage/BioLink: Customizable bio pages and profile link management
- Discord Bot Manager: Server management and Discord bot configuration tools
- Harmony: Real-time communication and chatting platform
- NexusHub: Content aggregation and community hub services
- Additional features and services as announced on the Platform
These Terms apply to all Services provided by The Wicked unless explicitly stated otherwise for a specific service.
2. User-Generated Content Policy
Users are fully responsible for all content they upload, share, distribute, or transmit through any of our Services, including but not limited to bio pages, profiles, chat messages, Discord bot configurations, uploaded media, and linked content. The Wicked does not pre-screen, monitor, or edit user content, and we cannot be held responsible for user-submitted materials.
2.1 Prohibited Content
The following types of content are strictly prohibited across all Services:
- Illegal Content: Any content that violates local, state, federal, or international law
- Intellectual Property Violations: Unauthorized use of copyrighted material, trademarks, or proprietary content
- Harassment & Hate Speech: Content targeting individuals or groups based on race, religion, gender, sexual orientation, disability, or other protected characteristics
- Adult Content: Sexually explicit material, pornography, nudity, or any content of a sexual nature
- Violent & Graphic Content: Gore, extreme violence, mutilation, torture, or promotion of self-harm or suicide
- Malicious Content: Malware, viruses, trojans, phishing attempts, or any harmful software
- Fraudulent Activity: Scams, impersonation, identity theft, pyramid schemes, or deceptive practices
- Spam: Unsolicited bulk messaging, commercial spam, or unauthorized automated bot activity
- Doxxing: Sharing private or personal information of others without explicit consent
- Cryptocurrency Scams: Pump and dump schemes, fake giveaways, rug pulls, or fraudulent crypto promotions
- Child Exploitation: Any content involving minors in inappropriate, sexual, or exploitative contexts (zero tolerance)
2.2 Content Monitoring & Enforcement
While we do not routinely monitor user content, we reserve the right to review, flag, remove, or disable access to any content that violates these Terms. We may take action based on automated systems, user reports, or manual review. Accounts found hosting prohibited content will be subject to immediate suspension, termination, and potential permanent blacklisting from all Services.
Serious violations (including illegal content, child exploitation, or credible threats) will be reported to appropriate law enforcement authorities.
3. Service-Specific Terms
3.1 Discord Bot Manager
When using our Discord Bot management tools, you agree to:
- Only configure the bot for Discord servers where you have proper administrative permissions
- Comply with Discord's Terms of Service, Developer Terms, and Community Guidelines
- Not use the bot for spam, raid coordination, harassment, or automated abuse
- Not attempt to reverse engineer, decompile, or extract source code from our bot
- Not use the bot to violate Discord's rate limits or API restrictions
- Be responsible for all bot actions taken through your account and configurations
- Not resell, redistribute, or provide commercial access to our bot services without authorization
We reserve the right to disable bot functionality for any server found violating Discord's policies, our Terms, or engaging in abusive behavior. Discord server bans do not entitle you to refunds.
3.2 Harmony Chat Service
Users of Harmony agree to:
- Maintain respectful and lawful communication with other users
- Not use the service for illegal coordination, planning criminal activity, or harassment
- Not share or solicit explicit, violent, or illegal content in any channels
- Report abusive behavior, threats, or violations through our reporting system
- Understand that chat logs may be reviewed in response to abuse reports or legal requirements
- Not impersonate other users, staff members, or automated systems
- Respect other users' privacy and not share private conversations without consent
3.3 BioPage/BioLink Service
BioPage users agree to:
- Only link to legitimate, legal websites and content
- Not use bio pages for phishing, malware distribution, scams, or illegal services
- Ensure all linked content complies with these Terms and applicable laws
- Not impersonate other individuals, brands, celebrities, or organizations
- Not use misleading URLs or deceptive link descriptions
- Respect intellectual property rights in all profile content and media
3.4 NexusHub
NexusHub users agree to:
- Submit only original content or content they have rights to share
- Properly attribute and credit original creators when sharing content
- Not engage in vote manipulation, fake engagement, or coordinated artificial activity
- Report content that violates these Terms or applicable laws
4. Account Management & Security
4.1 Account Responsibility
- You are fully responsible for maintaining the confidentiality of your account credentials
- You must be at least 13 years of age to create an account (or the minimum age required by your jurisdiction, whichever is higher)
- Minors under 18 must have parental or guardian permission to use paid services
- You may not share, sell, trade, or transfer your account to others
- You must provide accurate and current information during registration and profile updates
- You are responsible for all activities conducted through your account, including unauthorized access resulting from password compromise
- You must immediately notify us of any unauthorized use or security breach
4.2 Account Termination & Suspension
We reserve the right to suspend, terminate, or permanently ban any user account, with or without notice, for:
- Violation of these Terms of Service or service-specific terms
- Engaging in illegal activity or facilitating illegal conduct
- Abuse, harassment, or threats toward other users or staff
- Fraudulent behavior, payment chargebacks, or financial disputes
- Automated abuse, botting, or scraping without authorization
- Repeated violations after warnings or temporary suspensions
- Creating multiple accounts to evade bans or restrictions
- Any conduct we reasonably deem harmful to the Platform, community, or brand reputation
Users may voluntarily close their accounts at any time through their account settings. Account closures do not entitle you to refunds for unused subscription time or purchased features.
4.3 Ban Evasion
Creating new accounts or using alternate accounts to circumvent a ban or suspension is prohibited and will result in immediate permanent termination of all associated accounts.
5. Payment & Refund Policy
5.1 Payment Terms
Certain features and services may require payment. By making a purchase, you agree to:
- Provide accurate, current, and complete payment information
- Authorize The Wicked to charge the specified payment method for all fees
- Pay all applicable fees, taxes, and transaction charges
- Maintain valid payment information for recurring subscription services
- Update payment information promptly if it changes or expires
5.2 Refund Policy
ALL PAYMENTS MADE TO THE WICKED ARE FINAL AND NON-REFUNDABLE, unless otherwise required by applicable consumer protection law or explicitly stated for a specific service. By purchasing any service, subscription, or feature, you acknowledge and agree that:
- All sales are final for digital goods and services
- No chargebacks, refunds, or returns will be issued except as required by law
- Subscription fees are non-refundable, even if canceled mid-cycle
- One-time purchases and feature unlocks are non-refundable
- Account termination for Terms violations voids all purchase value
- Disputing legitimate charges may result in immediate account termination, permanent blacklisting, and legal action
- Refunds will not be provided for service outages, downtime, or performance issues
5.3 Subscription Management
You may cancel subscriptions at any time through your account settings, but:
- No partial refunds will be issued for the remaining subscription period
- Access and features will continue until the end of the current billing cycle
- Canceled subscriptions will not auto-renew at the next billing date
- Subscription benefits terminate immediately if you violate these Terms
5.4 Price Changes
We reserve the right to modify pricing for services at any time. Existing subscribers will be notified at least 30 days before price increases take effect and may cancel before renewal to avoid new pricing.
6. Intellectual Property Rights
6.1 Platform Ownership
All content, features, functionality, software, design elements, graphics, code, databases, logos, trademarks, and materials provided by The Wicked are owned by us or our licensors and are protected by United States and international intellectual property laws, including copyright, trademark, patent, and trade secret laws.
You may not:
- Copy, modify, distribute, sell, lease, or sublicense any part of our Services
- Reverse engineer, decompile, or disassemble our software or systems
- Remove, alter, or obscure any copyright, trademark, or proprietary notices
- Use our trademarks, logos, or branding without explicit written permission
- Create derivative works based on our Services
- Frame or mirror any part of the Services on another website
6.2 User Content License
By uploading or submitting content to our Services, you grant The Wicked a worldwide, non-exclusive, transferable, royalty-free, perpetual license to use, display, reproduce, distribute, modify, and create derivative works from your content solely for the purpose of operating, promoting, and improving the Services.
You represent and warrant that:
- You own or have necessary rights to all content you submit
- Your content does not violate any third-party rights
- Your content complies with all applicable laws
- You have obtained all necessary permissions, licenses, and consents
You retain all ownership rights to your content. We do not claim ownership of your submissions.
6.3 DMCA Compliance & Copyright Claims
We comply with the Digital Millennium Copyright Act (DMCA) and respond to valid takedown notices. If you believe your copyrighted work has been infringed on our Platform, submit a DMCA notice to dmca@thewicked.dev including:
- Your full name, address, phone number, and email
- Identification of the copyrighted work claimed to have been infringed
- Identification and URL of the infringing material on our Platform
- Statement that you have a good faith belief the use is not authorized
- Statement that the information is accurate and you are authorized to act
- Your physical or electronic signature
We will investigate valid claims and may remove infringing content. Repeated copyright violations will result in account termination.
6.4 Counter-Notification
If you believe your content was wrongly removed due to a DMCA notice, you may submit a counter-notification to the same email address with the required legal information.
7. Limitation of Liability & Disclaimers
7.1 Service "AS IS" Disclaimer
THE WICKED SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, including but not limited to:
- Warranties of merchantability or fitness for a particular purpose
- Warranties of non-infringement
- Warranties of accuracy, reliability, or completeness
- Warranties regarding availability, uptime, or performance
- Warranties that the Services will be secure, error-free, or uninterrupted
- Warranties that defects will be corrected
Some jurisdictions do not allow the exclusion of implied warranties, so some of the above exclusions may not apply to you.
7.2 Limitation of Damages
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE WICKED, ITS OWNERS, DEVELOPERS, EMPLOYEES, CONTRACTORS, AFFILIATES, AND LICENSORS SHALL NOT BE LIABLE FOR:
- Any indirect, incidental, special, consequential, exemplary, or punitive damages
- Loss of profits, revenue, data, use, goodwill, or other intangible losses
- Damages arising from user-generated content or third-party actions
- Unauthorized access to, use of, or alteration of your content or account
- Service interruptions, downtime, technical failures, or data loss
- Errors, bugs, or security vulnerabilities
- Your reliance on or use of the Services
- Third-party content, services, or conduct
- Any damages exceeding the amount you paid to The Wicked in the 12 months preceding the claim (or $100 USD if no payment was made)
This limitation applies regardless of the legal theory (contract, tort, negligence, strict liability, or otherwise) and whether we were advised of the possibility of such damages.
7.3 Indemnification
You agree to indemnify, defend, and hold harmless The Wicked and its affiliates, directors, officers, employees, agents, licensors, and suppliers from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorney fees and court costs) arising from or related to:
- Your use or misuse of the Services
- Your violation of these Terms or any applicable law or regulation
- Your violation of any third-party rights, including intellectual property, privacy, or publicity rights
- Any content you submit, post, transmit, or make available through the Services
- Any disputes between you and other users
- Any unauthorized use of your account resulting from your failure to secure it
We reserve the right to assume exclusive defense and control of any matter subject to indemnification, at your expense.
8. Data Protection & Privacy
8.1 Data Collection
We collect and store only the minimum data necessary to provide and improve our Services, including:
- Account Information: Username, email address, password (hashed and encrypted)
- Profile Data: Bio page content, settings, preferences, uploaded media, custom links
- Service Usage Data: Discord server configurations, bot settings, chat history (where applicable), feature usage patterns
- Technical Data: IP addresses, browser and device information, session logs, cookies, access times
- Payment Information: Processed through third-party payment processors; we store only transaction IDs and status
8.2 Data Usage
We do not sell, rent, trade, or share your personal data with third parties for marketing purposes. Your data is used solely to:
- Provide, operate, maintain, and improve our Services
- Process transactions and send related communications
- Personalize user experience and develop new features
- Investigate abuse reports, security incidents, and enforce these Terms
- Comply with legal obligations, court orders, and law enforcement requests
- Send important service announcements and security alerts
8.3 Data Security
We implement industry-standard security measures to protect your data, including:
- Encryption of passwords and sensitive data
- Secure HTTPS connections
- Regular security audits and monitoring
- Access controls and authentication systems
However, no system is completely secure. You acknowledge that data transmission over the internet and data storage systems carry inherent security risks, and we cannot guarantee absolute security.
8.4 Data Retention
We retain your data for as long as your account is active or as needed to provide Services. Upon account deletion:
- Most personal data is deleted within 30 days
- Some data may be retained for legitimate business purposes (fraud prevention, legal compliance)
- Publicly shared content may persist in backups for up to 90 days
- Anonymized usage data may be retained indefinitely for analytics
8.5 Third-Party Integrations
Our Services may integrate with or link to third-party platforms including:
- Discord (for bot functionality and OAuth authentication)
- Payment processors (Stripe, PayPal, or similar)
- Social media platforms (for OAuth login and sharing)
- Analytics providers
These third-party services have their own privacy policies and terms of service. We are not responsible for their data practices, and your interactions with them are governed by their respective policies.
8.6 Your Privacy Rights
Depending on your jurisdiction, you may have the right to:
- Access your personal data
- Request correction of inaccurate data
- Request deletion of your data (subject to legal retention requirements)
- Object to certain data processing activities
- Export your data in a portable format

9. Registration Codes & Access Control
Certain Services, features, or beta programs may require invitation codes, registration keys, or staff approval for access. Unauthorized sharing, selling, trading, or public posting of registration codes is strictly prohibited and may result in:
- Immediate revocation of access
- Account termination for all involved parties
- Permanent blacklisting from future access
- Cancellation of paid services without refund
10. Acceptable Use Policy
In addition to prohibited content listed in Section 2, you agree not to:
- Attempt to gain unauthorized access to our systems, servers, or other user accounts
- Interfere with, disrupt, or place undue burden on the Services or servers
- Use automated systems (bots, scrapers, crawlers) without explicit written authorization
- Collect, harvest, or mine user data without consent
- Engage in any activity that could damage, disable, overburden, or impair the Services
- Circumvent security features, access restrictions, or rate limits
- Probe, scan, or test vulnerabilities of our systems
- Forge headers, manipulate identifiers, or otherwise disguise the origin of content
- Use the Services to transmit viruses, worms, or malicious code
- Use the Services for any illegal purpose or to facilitate illegal activity
- Violate any applicable local, state, federal, or international laws or regulations
- Engage in commercial use without authorization (reselling, white-labeling, etc.)
11. Content Reporting & Enforcement
We take violations of these Terms seriously and encourage users to report problematic content or behavior. To report violations, abuse, harmful content, or suspicious activity:
When reporting, please provide:
- Your account information (if applicable)
- Description of the violation
- URLs or locations of the offending content
- Screenshots or evidence (when relevant)
- Any other relevant information
We will investigate all credible reports and may take action including:
- Content removal or account suspension
- Formal warnings to the violating user
- Temporary or permanent account termination
- Reporting to law enforcement (for serious violations)
False reports, spam reports, or abuse of the reporting system may result in action against the reporting account.
12. Modifications to Terms
We reserve the right to modify, update, amend, or change these Terms of Service at any time, at our sole discretion. When material changes are made:
- The "Last Updated" date at the top will be revised
- Significant changes will be announced via email, platform notifications, or prominent notice
- You will be given reasonable opportunity to review changes before they take effect
- Continued use of the Services after changes take effect constitutes acceptance of the modified Terms
We encourage you to review these Terms periodically. If you do not agree to modified Terms, your sole remedy is to discontinue use of the Services and close your account.
13. Service Changes & Discontinuation
We reserve the right, at our sole discretion, to:
- Modify, suspend, or discontinue any Service, feature, or functionality at any time
- Add, remove, or alter features without prior notice
- Change pricing, subscription tiers, or payment structures with reasonable advance notice
- Discontinue support for specific platforms, browsers, or older versions
- Implement new restrictions or limitations on usage
- Perform scheduled or emergency maintenance with potential service interruptions
We are not liable for any modification, suspension, or discontinuation of Services. No refunds will be provided for discontinued services unless required by law.
14. Governing Law & Dispute Resolution
14.1 Governing Law
These Terms are governed by and construed in accordance with the laws of the United States and the state in which The Wicked operates, without regard to conflict of law principles. You consent to the exclusive jurisdiction of courts in that state for resolution of disputes.
14.2 Dispute Resolution Process
For any dispute, claim, or controversy arising from or relating to these Terms or your use of the Services:
- Informal Resolution: First, contact us at legal@thewicked.dev to attempt informal resolution. Provide a detailed description of the dispute and desired resolution.
- Negotiation Period: We will attempt to resolve the dispute through good faith negotiations for 30 days.
- Binding Arbitration: If informal resolution fails, disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, rather than in court.
- Court Action: If arbitration is unavailable or unenforceable, disputes shall be resolved in a court of competent jurisdiction in our operating state.
14.3 Class Action Waiver
You agree to waive your right to participate in class action lawsuits or class-wide arbitration against The Wicked. All disputes must be brought individually, and you may not consolidate claims with those of other users.
14.4 Time Limitation
Any claim or cause of action arising from or related to these Terms or the Services must be filed within one (1) year after the claim arose, or it will be permanently barred.
14.5 Injunctive Relief
Notwithstanding the arbitration requirement, we may seek injunctive or equitable relief in any court of competent jurisdiction to protect our intellectual property rights or prevent irreparable harm.
15. Export Compliance & International Use
The Services are controlled and operated from the United States. You agree to comply with all applicable export and import laws and regulations, including:
- U.S. Export Administration Regulations (EAR)
- Office of Foreign Assets Control (OFAC) regulations
- International Traffic in Arms Regulations (ITAR), if applicable
You may not use, export, or re-export the Services in violation of U.S. export laws or the laws of any other applicable jurisdiction. You represent that you are not:
- Located in a country subject to U.S. government embargo
- Listed on any U.S. government list of prohibited or restricted parties
- Subject to sanctions or export restrictions
16. Government and Enterprise Users
If you are a U.S. federal, state, or local government entity, or using the Services on behalf of a government entity, you acknowledge that the Services and related documentation are "commercial items" as defined by applicable Federal Acquisition Regulation (FAR) and agency supplements, and your use is subject to these Terms.
17. Assignment & Transfer
You may not assign, transfer, delegate, or sublicense your rights or obligations under these Terms without our prior written consent. Any attempted assignment in violation of this section is void.
We may assign or transfer these Terms, in whole or in part, at any time with or without notice, including in connection with a merger, acquisition, corporate reorganization, or sale of assets.
18. Severability
If any provision of these Terms is found to be invalid, unlawful, void, or unenforceable by a court of competent jurisdiction, that provision shall be deemed severable from the remainder of these Terms and shall not affect the validity or enforceability of the remaining provisions, which shall remain in full force and effect.
19. Waiver
Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision unless acknowledged and agreed to in writing by an authorized representative of The Wicked. No waiver of any term shall be deemed a further or continuing waiver of such term or any other term.
20. Entire Agreement
These Terms of Service, together with our Privacy Policy (if separately posted), service-specific terms, and any other legal notices or policies published by The Wicked, constitute the entire agreement between you and The Wicked regarding the Services and supersede all prior or contemporaneous agreements, proposals, communications, or understandings, whether oral or written.
21. Force Majeure
We shall not be liable for any failure or delay in performance of our obligations under these Terms due to causes beyond our reasonable control, including but not limited to:
- Acts of God, natural disasters, earthquakes, floods, hurricanes, or extreme weather
- War, terrorism, civil unrest, riots, or government actions
- Internet outages, telecommunications failures, or infrastructure disruptions
- Pandemics, epidemics, or other public health emergencies
- Labor disputes, strikes, or lockouts
- Third-party service provider failures or data center outages
- Cyberattacks, DDoS attacks, or security incidents
- Power outages or equipment failures
In such events, we will make reasonable efforts to minimize service disruptions but shall not be liable for any resulting damages or losses.
22. Survival
The following sections shall survive termination of these Terms or closure of your account: Intellectual Property Rights, Payment & Refund Policy, Limitation of Liability, Indemnification, Governing Law, Dispute Resolution, and any other provisions that by their nature should reasonably survive.
23. Language & Translation
These Terms are written in English. Any translated versions are provided for convenience only. In the event of any conflict between the English version and a translated version, the English version shall prevail.

25. Acknowledgment & Acceptance
By registering for an account, accessing, or using any of The Wicked's Services, you acknowledge that:
- You have read, understood, and agree to be bound by these Terms of Service
- You have reviewed and consent to our data collection and usage practices
- You have the legal capacity and authority to enter into this binding agreement
- You are at least 13 years of age (or meet the minimum age required by your jurisdiction)
- If representing an organization, you have authority to bind that organization to these Terms
- You understand the limitations of liability and warranty disclaimers
- You agree to comply with all applicable laws and regulations
If you do not agree to these Terms, you must immediately cease all use of the Services and close your account.
